1. Definitions

“Domain” means an internet domain name listed on Nameica.com; “Buyer” includes outright purchasers and Lease‑to‑Own customers; “Lease‑to‑Own Plan” (L2O) means a 12‑month instalment arrangement for eventual transfer of ownership; “Services” means our marketplace platform, tools, and associated support.

2. About Nameica

Nameica is an online marketplace that brokers the sale and lease‑to‑own of domain names between domain owners (“Sellers”) and Buyers. We are not a registrar and do not provide web‑hosting.

3. Eligibility & Account Registration

You must be 18+ and legally able to enter contracts. Accurate information is required. We may suspend or terminate accounts that breach these T&C.

4. Buying a Domain – Outright Sale

4.1 Price shown on the listing page is the total purchase price exclusive of any applicable VAT or local taxes, which will be added at checkout.
4.2 Payment must clear in full before transfer is initiated.
4.3 Transfer is completed via the registrar specified in your control panel. You are responsible for providing correct transfer details.

5. Lease‑to‑Own Plan (12 months)

5.1 You pay twelve equal monthly instalments (or sooner if you choose to pre‑pay).
5.2 Title to the Domain remains with Seller (or Nameica acting as escrow) until all instalments clear. You receive a licence to use the Domain during the lease term.
5.3 Missed payment: If an instalment is more than 30 days overdue, we may suspend DNS, cancel the L2O agreement and retain all amounts already paid.
5.4 Early cancellation: You may cancel at any time. No further instalments are due after cancellation, but prior payments are non‑refundable.

6. Refund & Cancellation Policy

(a) Outright sale (Buy‑Now). You may request a full refund within 24 hours of purchase, provided transfer has not been initiated. Contact support through your dashboard or by email/phone.
(b) Lease‑to‑Own. You may cancel at any time as described in 5.4. No refunds are given for instalments already paid.
(c) Statutory rights. These terms do not affect any non‑excludable consumer rights under UK law.

7. Permitted Use of Lease to Own Domains

The Domain must not be used for unlawful, misleading, or infringing activities, including but not limited to: spam, malware distribution, hate speech, or violations of sanctions.

8. Intellectual Property & Logos

Any logo, brand‑kit, or creative assets displayed with a Domain remain © Nameica or the original creator and are licensed to you only upon completion of the purchase/L2O.

9. Limitation of Liability

To the extent permitted by law, Nameica shall not be liable for: loss of profits, business interruption, goodwill, data, or any indirect or consequential loss arising from use of the Services or Domain. Our total aggregate liability is limited to the amount paid to us for the relevant transaction.

10. Indemnity

You agree to indemnify and hold Nameica harmless from claims, damages, and expenses (including legal fees) arising out of your misuse of a Domain or breach of these T&C.

11. Governing Law & Jurisdiction

These T&C, and any dispute or claim (including non‑contractual), are governed by English law. The courts of England and Wales have exclusive jurisdiction.

12. Amendments

We may update these T&C from time to time. Changes become effective when posted. Material changes will be notified by email where practicable.

13. Complaints & ADR

If you have a complaint, contact us first. If unresolved, you may use the EU Online Dispute Resolution (ODR) platform or another accredited UK ADR provider. We are not obliged to participate in ADR but will consider reasonable requests.
